Bars Insurance Company to Pay over One Million for Fatal Bicycle Crash Caused By Alcohol

A lawsuit filed by the parents of the rider has been settled in amounts over one million dollars against the driver and a bar’s insurance company that served a bicyclist who was fatally wounded in December of 2006 after being hit by a drunk driver.

John Osborne, the plaintiff’s attorney said Robert L’Ecuyer and Barbara Nordlund agreed to the offer from Berky’s in the amount of $1 million dollars for the death of Paul L’Ecuyer. $25,000 is to be paid on Monday by Melissa Arrington’s insurance company, being just one day prior to the trial that was to be held in the Pima County Superior Court.

The death of Paul L’Ecuyer’s death resulted in a 10.5 year prison sentence for Arrington, decided in January 2008 by a jury who found her guilty of aggravated DUI and negligent homicide.

Jurors were told by prosecutors that about 8:40 p.m. 45 year old L’Ecuyer was in the bike lane on his Schwinn when Arrington struck him after swerving off of the road and finally coming to a stop after going 800 more feet.

Already driving on a license that had been suspended, Arrington’s blood-alcohol level showed to be 0.156 in a test that was performed 2 2/3 hours after the accident occurred, being twice the level for a DUI. Witnessing the crash, a witness stated that before the collision occurred Arrington had swerved off of the road two other times.

Arrington’s lawyers stated the collision was just a tragic accident.
Arrington stated in testimony that she had recently signed an agreement for lease to purchase on her home located in Vail, and stopped at Berky’s located at 5769 E. Speedway to celebrate with her friends, where she had three drinks. She also stated that as she was reaching for hand sanitizer is when the accident occurred.

Osborne stated that L’Ecuyer’s parents filed the lawsuit against Arrington and Berky’s as a reminder to everyone how important the need is to continue “working tirelessly to do away with drinking and driving and to over-serving at bars."
Osborne said that the plans for the settlement are going to be used for the funding of a scholarship named after their son shortly after he lost his life, and for the education of their nephews’ and neices’. Part of the money might also be donated to Phoenix College and the University of Arizona.

When Arrington was being sentenced, Judge Michael Cruikshank stated the reason an aggravated sentence was given to Arrington was because of a recorded phone call that he found between a friend and Arrington to be "breathtaking in its inhumanity." Instead of being silenced from shock, Arrington laughed during the call that was made from Pima County jail where the gentleman told Arrington that someone they were both acquainted with said she deserved "a medal and a (expletive) parade because she had taken out "a (expletive) tree hugger, a bicyclist, a Frenchman and a gay guy all in one shot."

When the man stated it was a terrible thing for him to say, after laughing Arrington simply responded with "No, it's not." During the proceedings of the hearing, siblings and L’Ecuyer’s mother described him as being being a person with "enormous ideals" who helped pass out Martin Luther King Jr. Day fliers and urging others to write down their goals and dreams, who rode in other charity events and handed out baskets to needy people for the Thanksgiving holiday.

L’Ecuyer held degrees in counseling and career development from Phoenix College and the University of Arizona, as well as degrees from Chapman University.
A phone call for comment was not returned by Martin Claire, an attorney from Phoenix that represents Berky’s.

Child Bicycle Rider Killed In Accident with Pickup Truck

December 3, 2009 (by Horatio Algren) According to reports a nine year old child was struck by a pickup truck while riding his bicycle.

According to Anaheim Police officer Sgt. Rick Martinez the police and paramedics were called to the scene of the bicycle accident at approximately 2:30 p.m. Thursday. The accident occurred on Orangewood Avenue and Loara Street when a boy riding a red bicycle was struck by a white pickup truck.

Sgt. Martinez stated that the at the time of the accident the driver of the truck was headed westbound and it is unclear was direction the bicycle rider was traveling in.

Both Orangewood Avenue and Loara Street as far as Euclid Street has been closed for several hours while Anaheim police investigators inspect the scene. The boy that was struck and killed was transported to UCI Medical Center in Orange where he was pronounced dead a short time later, according to Sgt. Martinez. Neither the identity of the child or the driver of the white pickup truck has come out.

Irvine Accident Sends Bicyclists To The Hospital

November 16, 2009 (by Horatio Algren) According to reports a bicyclists was hospitalized after a morning Irvine accident.

The rider identified as a 45 year old female was seriously injured when he was struck by a 71 year old driver in Irvine. The accident occurred at approximately 7:00 a.m. when the driver was traveling eastbound on Irvine Center Drive and collided with the bicyclist, according to Lt. John Hare.

The rider was wearing a helmet at the time of the accident and was treated at the scene by emergency personnel and then transported to an area hospital according to Lt. Hare. The 71 year old male driver was not injured in the accident.

The woman injuries have not been released and authorities are continuing to investigate the accident and what might have been the cause. They are also asking anyone that witnessed the bicycle accident to contact Detective Jonathan Cherney.

Elderly Bicycle Rider Killed When Struck By Pickup Truck

October 22, 2009- According to reports by a bicycle accident attorney, an elderly bicycle rider was struck and killed in Yorba Linda.

The bicycle rider that was killed in a Wednesday night bicycle accident has been identified as 80 year old Edelgard Owens a resident of Placentia.

According to Brea Police Department Sgt. Bill Smyser Owens was riding a bicycle on the sidewalk on East Imperial Highway when the accident occurred Owens was crossing the street at Prospect Avenue in Yorba Linda. The accident occurred at approximately 5:40 p.m. when according to preliminary reports Owens crossed against a red light and a woman driving a full sized pickup truck had a green arrow striking the bicyclist.

According to Sgt. Smyser police gave the woman a sobriety test and arrested her on allegedly driving under the influence.

According to Lt. Gregg Hayden after further investigation the woman was released after it was found she was not driving under the influence.
Owens was transported to Placentia Linda Community Hospital where she was pronounced dead.

Bicyclist Pinned Under Bumper of Big Rig After Being Struck

October 8, 2009 (by Horatio Algren) According to reports a bicyclist was pinned under the bumper of a big rig after being struck in the early morning hours. Anaheim traffic investigator Rick Alexander stated that the accident occurred at approximately 5:43 a.m. in the vicinity of Kraemer and the eastbound off-ramp of the 91 Freeway. The bicyclist was traveling southbound along the west curb at the time of the accident.

The accident closed the off ramp of the freeway, along with Kraemer that was closed from La Palma Avenue to Frontera Street, while the scene of the accident was investigated, according to Alexander. According to the investigator what was found is that the semi- truck was stopped at the off ramp and as it began to accelerate and make a right hand turn the rider of the bicycle peddled in front of the big rig.
The rider did not have head lights and according to a witness after the bicyclist was knocked to the ground they yelled to the driver of the truck to stop, which he did.

The rider of the bicycle was pinned underneath the bumper of the big rig and was transported to the hospital with serious injuries. According to at least one bicycle injury lawyer, Alexander the rider was transported to UCI Medical Center in Orange.

Identity of Man Fatally Injured In Huntington Beach Bicycle Crash Released

September 17, 2009 (by Horatio Algren) According to reports a 67 year old man that was killed in a weekend accident has been identified as Kevin Petrimoulx a resident of Huntington Beach.

Petrimoulx was killed at approximately 1:00 p.m. Sunday after he fell from his bicycle, and according to Huntington Beach Police Lt. Russell Reinhard he was not wearing a helmet at the time of the accident.

The Huntington Beach man was reported to police by a passerby that reported he was lying on the ground and police have found no witnesses to Petrimoulx falling from his bike. Huntington Beach Traffic Investigators are attempting to piece together what occurred that caused Paetrimoulx to crash landing on the ground at Greentree Lane south of Warner Avenue. Lt. Fred Corral from the Los Angeles County Coroner’s Office Investigations stated that they are investigating Petrimoulx death as an accident.

The wife of the fatally injured bicycle rider stated that he rode his bicycle daily from Warner Avenue to PCH and the city pier, along with riding his bike every Sunday to St. Bonaventure Church in Huntington Beach to attend Sunday Mass.
Petrimoulx was originally a police officer in Detroit and owned an Anaheim Hills chop house, Foxfire Restaurant.

Bicycle Safety Fair Motivated After Fatal Injury Of Long Time Biker

September 16, 2009 (by Horatio Algren) According to reports an area bicycle safety fair that is planned to be held will focus on bicycle safety following the death of long time area biker.

The safety fair will be held at St. Timothy’s and will focus on bicycle rider safety following the death of organizer Dave Wilde’s father-in-Law, retired Stanford University Law Professor John Barton. The law professor was fatally injured while writing his bicycle in Los Altos on July 14th, injuring his head in two places.

Barton was an avid bike rider and was wearing a helmet at the time of the accident, which took his life on August 3rd. The head injuries were severe enough to have broken the 72 year old man’s eye socket, leading doctors to believe he might have been a victim of a hit and run accident.

Police investigating the accident have found no evidence of a vehicle being involved in Barton’s fatal injuries according to reports. The Stanford University law professor and local resident was the father of five children including his son John who is a Palo Alto City Council member.

Bicyclist Struck By Vehicle At I-5 Off Ramp

June 17, 2009 (by Horatio Agren) According to reports a bicyclist was injured after being struck by a vehicle, while crossing the I-5 Freeway off ramp.

The California Highway Patrol was called to the scene of a two vehicle accident at approximately 8:29 a.m., at the scene of the accident they found it was a vehicle that had struck a bicyclist. The accident occurred in the vicinity of southbound Jeffery Road and Roosevelt, according to the initial report, they learned at the scene the collision occurred at the off ramp.

The bicyclist was transported from the scene of the accident to the Kaiser Medical Center, and the condition of the rider has not been released.

Capt. Greg McKeown of the Orange County Fire Authority stated the person that was injured in the vicinity of southbound Jeffery Road and Roosevelt was a pedestrian, rather than a bicyclist.

TV Host of Extreme Makeover: Home Edition Offers Reward In Santa Monica Hit and Run Bicycle Accident

According to reports Ty Pennington host of one of the popular weekly television program Extreme Makeover: Home Edition, is offering a reward. The reward is for information leading to the arrest of a hit and run driver that seriously injured a bicyclists.

Pennington is offering a $10,000 reward for information about a hit and run accident that occurred in Santa Monica when a relative of his co-manager was struck on January 17th by a hit and run driver. The man that was struck by the vehicle is Daniel Seeck age 33, he was struck by a vehicle while riding his mountain bike in the vicinity of 20th street traveling southbound according to Santa Monica Police Department traffic investigator Chris Dawson.

According to Penningtons co-manager Bill Stankey, Seeck was critically injured, his injuries include head trauma, nine broken ribs, a punctured lung, and he is currently at UCLA Medical Center on life support. Seeck is Bill Stankey’s wife’s cousin and according to reports he was not wearing a helmet at the time of the hit and run accident.

The traffic investigator Chris Dawson stated that Seeck was knocked to the ground by the vehicle, suffering severe injuries. He and his mountain bicycle were run over by the vehicle, which then left the scene without stopping. Dawson also stated the accident occurred at approximately 12:20 p.m. and according to witnesses the accident the vehicle was a dark colored sport utility vehicle.
